ICES - Tuition terms & conditions
The College and the Student agree to the following terms and conditions:
1. The Definitions:
“College” or "ICES" means the International College of Environmental Sustainability P/L ABN 70 140 864 366. "Enrolment Fee" means the enrolment fee as set out in the fee Schedule. "Fees" means the fees that are due and payable for tuition and courses delivered by the College to the Student for the Course in which the Student has enrolled/applied, as specified in the Schedule. “Student" means the other party to this signed agreement. “Course" means the course in which the Student is enrolling as specified in the Schedule. “Premises” means any campus buildings or locations used or occupied by the College to provide the Course to the Student.
2. The Conditions:
2.1 The Student agrees to, and is subject to, the Course terms and conditions.
2.2 The College reserves the right to discontinue performance of the Course at its own discretion; however, if the College excises this right, the College will issue a refund to the Student for any Fees paid by the Student in respect of tuition not received on a pro-rata basis.
3. Responsibility:
3.1 The Student acknowledges and agrees that the College shall not be liable to the Student for:
(a) damage to, or loss of any goods or property of the Student, including in respect of loss or damage caused by or arising from any negligence of the College, its employees, subcontractors, agents, servants or defective equipment.
(b) damage to, or loss that may occur to the Student upon travelling to and from its training facilities.
4. Acknowledgment:
4.1 The Student acknowledges and agrees that:
(a) The College takes no responsibility for the personal views of students or the responses to the views of others in relation to any issues of morality, sexuality, religious views and the like. The views expressed by the College's employees, subcontractors, students, agents and servants are not necessarily those of the College.
(b) The Student will respect the rights of students and staff to a positive and safe learning environment. The Student may be asked to leave the Premises if their behaviour is threatening, intimidating or disruptive.
(c) The College shall have no responsibility or liability to the Student for the actions of other students on or off the Premises.
(d) The College may need to amend, change or postpone class timetables and teachers in an emergency or an unforseen circumstance, and the College reserves its right to do so without prior notice to the Student. The College will endeavour to give advance notice to the Student of any changes, where reasonably possible.
(e) The College takes no responsibility for, and makes no representations regarding the future prospects of the Student in obtaining employment in the industry or with regard to establishing a career in the industry.
(f) The Student will be required to pay for the replacement or repair of any equipment of the College which is damaged or destroyed by the Student.
(g) The Student acknowledges that all due diligence and care has been take by the College to research, obtain and deliver current information based on extensive global research and government policy of the day.
5. Transfers:
5.1 Enrolment in the Course is not transferable and this agreement cannot be assigned without the prior written approval of the College. The College reserves the right to suspend, cancel or defer a Student’s agreement if the College faculty or administration, deem their performance or behaviour un-acceptable to the College and Students.
6. Suspension or Deferral:
6.1 The Student cannot defer enrolment in the Course under this agreement without the prior written approval of the College. Approval of a request for deferral may be subject to the payment of a deferral fee. Fees cannot be deferred under this agreement, unless approved by the College administration.
7. Fees:
7.1 The Student agrees to pay the Fees as set out in the fee Schedule. If the Student’s fee account is in any way overdue or unpaid, the College reserves the right to disable access to the campuses and all classes until the account is paid up to due date or settled in full. If tuition fees balance or instalment is not paid within 28 days of your due date a late payment penalty of 10% of the due balance is automatically applied against your account and the Student may lose their place in the Course. If a student submits a rejected (bounced) cheque payable to the College, a $55 fee will be issued against the Student.
7.2 Enrolment in the Course is not secured into the Course until the application is submitted and Tutorial Agreement is signed by the Student and returned to the College and either the full tuition fees are paid in full, unless an agreed arrangement is made with the College administration.
7.3 The tuition fees once remitted, are non-refundable. Where the Student wishes to withdraw, defer, unable or decides not to attend the Course. The undersigned student agrees that any fees paid to date are non-refundable.
7.4 If the Student decides not attend the course, defer or withdraws, the undersigned Student agrees they have independently read and understood the terms of this 7.3 clause.
8. Indemnities
8.1 The Student indemnifies the College against all damage, loss, cost and expense (including legal costs and expenses) arising directly or indirectly from or in connection with:
(a) any injury to or death of any person; or
(b) any damage to real or personal property, caused or to the extent contributed to by an act or omission of the Student.
9. Assessments:
9.1 Students are responsible for ensuring that work is submitted within the set assessment period. The College may accept late submissions where the Student has supporting documentation of special circumstances such as a medical certificate. Late submissions will only be accepted within a specified time. In cases where late submissions are not supported by acceptable supporting documentation of special circumstances, the acceptance of a late submission will be at the College's absolute discretion and may be subject to a late assessment fee to cover the College's reasonable administrative costs. Assignments will not be assessed if it is evident that the submission requirements have not been met.
10. Other
10.1 The Student agrees to allow the College to use any imagery or works, produced and/or submitted for use in promotional advertising, exhibitions, publications or websites for the promotion of the College.
I have independently read and understood the fee structure and the above terms and conditions agree to abide by them.
